EDITORIAL: Another reader comments on the lead post.

The IRS incorporation document he is referring to is (OFFSITE LINK):

    SEDM Exhibit #08.006

    EXHIBITS PAGE: http://sedm.org/Exhibits/ExhibitIndex.htm

    __________

Tracey M hits on some good points. Some of the gaps can be filled in to help him if he wants courtesy of Ed Rivera's findings at:

    http://edrivera.com

The hierarchy of law is as follows:

    1. Declaration of Independence (DOI). (First law)

    2. Article of Confederation (AOC). (Second law)

    3. Northwest Ordinance (NWO). (Third law)

    4. Constitution of the United States (Con). (Fourth law)

All law cannot exceed the ordination of power of its predecessor. Largely the 4th law Con is 90% of the ilk as the 3rd law of the USA, the NWO. The NWO says its temporary so correct in flow would be to make it permanent with the Con. The 3rd law prevents a lot of things the United States, as a proprietary territory of ownership of the USA, the confederacy, can do. Here it is straight from the 3rd law: Art. 4. The said territory, and the States which may be formed therein, shall forever remain a part of this Confederacy of the United States of America, subject to the Articles of Confederation, and to such alterations therein as shall be constitutionally made; and to all the acts and ordinances of the United States in Congress assembled, conformable thereto. The inhabitants and settlers in the said territory shall be subject to pay a part of the federal debts contracted or to be contracted, and a proportional part of the expenses of government, to be apportioned on them by Congress according to the same common rule and measure by which apportionments thereof shall be made on the other States; and the taxes for paying their proportion shall be laid and levied by the authority and direction of the legislatures of the district or districts, or new States, as in the original States, within the time agreed upon by the United States in Congress assembled. The legislatures of those districts or new States, shall never interfere with the primary disposal of the soil by the United States in Congress assembled, nor with any regulations Congress may find necessary for securing the title in such soil to the bona fide purchasers. No tax shall be imposed on lands the property of the United States; and, in no case, shall nonresident proprietors be taxed higher than residents.

What would constitute interference? Why creating a new state. Or translation,

    Quote:
“You be bitch and ho …you US…you State of California…I be your pimp as USA. Anyone who lives in the ho house is on my proprietary territory exists as I say so and must pay a tax to me the pimp. ” [The entire origin of any taxes is right in the 3rd law]

What changes all of it is when they sell the territory…then the law refers back to the law that existed at the 1st law, the Declaration of Independence (DOI), which was the unwritten law as an entitlement so expressed in same document.

With that Art IV out of the NWO can you see why the State of California constitution says it so plainly and clearly and is in total congruence with the NWO Art IV and the Con?:

    Quote:
Article 3 Section 1: “The State of California is an inseparable part of the United States of America, and the United States Constitution is the supreme law of the land.”

BTW on USA Inc registered State of Delaware: One time I looked into the various things such as IRS, Inc. etc…being registered with the various states as corporations. I found they had nothing to do with the mythology that they were registered government entities. Years ago I found Internal Revenue Service Inc. as a coporation sole…ha ha. [someone thought ahead…oh…the IRS already levied my paycheck.] We should ask for the Inc. charter documents with USA, INC. registered with State of Delaware and find out what it says…wager $100 it has nothing to do with USA, the confederacy. So I suspect names and labels can mean many things depending on usage…for example..

    http://www.cwv.org/

Now this is interesting look at this quasi one:

    http://www.healthfinder.gov/orgs/HR2416.htm

One of these on the IRS I looked into and found nothing more in its incorporation documents than basically tax preparation services…but the others are interesting:

    http://www.myspace.com/abundancechild/blog/471723123

The NWO as 3rd law put on notice that propritary power over territory of ownership was near limitless and included the authority to create states. Those that deny proprietary power today would literally live in the dark–especially out west. The whole authority of the federal govt to sell electricity is based upon it….and that flows from the con….and that power flows from the NWO….and all that territory [aka State of XYZ] is all from an awarded to the USA by the King in the treaty of Paris. Just like electricity…all the power must flow from an origin.

EDITORIAL: Here is a comment on the above article we received from a very educated reader. We didn't write this, so please don't ask us to defend it.

    ____________

He has done a very good job of attempting to determine how the spawn of satan from the BAR Assoc who now operate all of our government and administration of Texas erected a foreign commercial state within the borders of the lawful de jure state, but he remains in confusion over only a few very minute details, that, once he internalizes these definitions, all will be crystal clear to him and he will speak with absolute authority and make all spawn from the BAR go silent and never ever engage in dialog with him ever.

There are 3 states of Texas, as there are 3 states of all of the original 15 states. The other states came up the commercial side into statehood as commercial territories and therefore never had a sovereign nation statehood:

    1. The state called “the state of Texas” is the dirt within the outer borders of Texas and the people sojourning on top of the land who came from God in Heaven.

    2. The state called “the State of Texas” is the people collectively operating in their sovereign commercial capacity through their lawfully elected house, senate, Secretary of State, Department of Treasury, and governor. Today we only have “comptrollers” which are only commercial fascist corporate bean counters of “this state.”

    3. The state called “this state” is a legal subdivision of “the state of Texas” and of “the United States” called “THE STATE OF TEXAS” and is a communitarian welfare benefit plantation subsidiary of “the United States,” a “district,” as defined on the CIA website, and the benefits are administered though the Texas State Department of Labor, as are the benefits administered in all other states for their respective legal subdivisions, because the benefits of “the United States” delivered are in relationship to the labor of the people/employees/slaves and their ability to be taxed for the payment of the tribute and the interest on the debt of “the United States” owed to the East India Trading Company as the servicer, and ultimately the Pope, in his declared sovereign capacity as the lien holder of title to everything God has created on Earth, which unapportioned debt service is applied to US citizens/persons/employees/slaves and collected through the clause 4 of the 14th Amendment.

The several counties of this state are “legal” subdivisions of the state as defined in the Texas Constitution of 1876 at Article 11 section 1.

    http://tarlton.law.utexas.edu/constitutions/constitutions.html

Lastly, there can be no sovereign Texas judiciary in Article 5 of the Texas Constitution, because on November 5, 1985 the people amended out of the constitution at Article 5, section 12, the right of the judiciary to issue writs and process in the name of the lawful collective of the people commercial state called “the State of Texas.” All law now moves only by PRIVATE contract.

Writs and process are now only issued out of the federal commercial state district called “this state,” “THE STATE OF TEXAS.” The writs and process from the state called “this state” only apply to people who have become statutory “U.S. persons”/”U.S. citizens” by applying for and accepting membership into the Social Security Administration and who have voluntarily become deemed statutory “employees” of the government and therefore subject to franchise “benefits”. See Ashwander v TVA 297 U.S. 288.

Except for the failure of full disclosure, everything done by the spawn of satan in the BAR Assoc is lawful and legal. And the maxim of law is: “Every man is presumed to know the law.” You would not have contracted to be deemed a statutory “employee” if you did not want the franchise “benefits”.

    Euroreiner,

This is an EXCELLENT article! Thank you for sharing it and for all the hard work you obviously put into it. We took the time to format it, remove spelling errors in order to make it easier for our readers to follow.

Your article is so good that it looks like the SEDM sister website decided to use and improve upon it. We are told that the article in enhanced form now appears as the following:

    Franklin,

Apparently, SEDM agrees with your philosophy of questioning everything. Their Member Agreement, which we agree with, says the following about the subject of questioning everything and avoiding presumptions:

    Quote:
    9. I will stop making any and all presumptions about what the law requires and will stop believing or saying anything that I haven't proven for myself by reading the law. I will stop believing what others tell me about what the law requires and rely ONLY on legally admissible evidence in reaching my own conclusions. I recognize that this is the most important way that I can:

9.1 Protect the credibility and success of the freedom movement.

9.2 Protect the credibility and success of this ministry.

9.3 Protect my own credibility and prevent me from being called “frivolous”.

9.4 Prevent the legal profession and/or the government from becoming a state-sponsored civil religion in violation of the First Amendment. See Socialism: The New American Civil Religion, Form #05.016.

For the reasons why, see: Presumption: Chief Weapon for Unlawfully Enlarging Federal Jurisdiction, Form #05.017.

    New malware steals your Bitcoin

By Kevin Poulsen, wired.com | Published 3 days ago

In a sure sign that the virtual currency Bitcoin has hit the mainstream, a new Trojan horse program discovered in the wild Thursday seeks out and steals victims’ Bitcoin wallets, the same way other malware goes for their banking passwords or credit card numbers.

The malware, Infostealer.Coinbit, is fairly simple: it targets Windows machines and zeroes in on the standard file location for a Bitcoin wallet. It then e-mails the wallet—a data file containing private crypto keys—to the attacker by way of a server in Poland, according to Symantec, which was first to alert on the attack.

“If you use Bitcoins, you have the option to encrypt your wallet and we recommend that you choose a strong password for this in the event that an attacker is attempting to brute-force your wallet open,” Symantec’s Stephen Doherty wrote in a blog post Thursday.

Bitcoin is an anonymous, decentralized virtual currency that’s been percolating for the last two years, and broke out into widespread attention with Gawker’s excellent June 1 story on Silk Road, the online drug market where Bitcoin is the standard currency. Independent of any national currency, Bitcoin is exchanged peer-to-peer, or earned by users who contribute CPU cycles to mathematically generating new Bitcoin, a process called “mining.”

Hacker-types have been sniffing around Bitcoin since at least April, when a program called Stealthcoin debuted that’s tailor-made for turning a botnet of compromised computers into a covert parallel Bitcoin mining machine. The first actual theft of Bitcoins was reported this week by a user who claimed a hacker transferred 25,000 BTC from his machine, theoretically worth about $500,000 at current exchange rates.

With its single-minded focus, Infostealer.Coinbit has the feel of an interim solution. In the future, Bitcoin theft will probably be a standard feature in full-featured Trojans.

Bitcoin prices plummet on hacked exchange

By Timothy B. Lee | Published about 18 hours ago

The Bitcoin community faced another crisis on Sunday afternoon as the price of the currency on the most popular exchange, Mt.Gox, fell from $17 to pennies in a matter of minutes. Trading was quickly suspended and visitors to the home page were redirected to a statement blaming the crash on a compromised user account. Mt.Gox's Mark Karpeles said that the exchange would be taken offline to give administrators time to roll back the suspect transactions.

The extent of the compromise became clear when a copy of Mt.Gox's user database began circulating online. The file included username, email addres, and hashed password for thousands of Mt.Gox users. Karpeles's statement was updated to acknowledge the breach. He warned users who have re-used the Mt.Gox passwords on other sites to change them.

The crash appears to be the fault of the Mt.Gox exchange rather than a collapse in the value of the currency itself, as the integrity of Bitcoin's underlying peer-to-peer transaction clearing process does not appear to have been compromised. Prices at a competing exchange showed Bitcoins trading down about 25 percent to $13 per Bitcoin earlier today, although it has edged up since.

It's been a bad weekend for Mt.Gox, which until now has been the most popular method for converting between Bitcoins and more conventional currencies. Earlier in the weekend, it was reported that the site was vulnerable to a cross-site request forgery in which a logged-in user could be tricked into submitting fraudulent transaction requests. On Sunday, dozens of irate Bitcoin users pledged to stop using the exchange, arguing that the site's administrators lacked the technical sophistication to build a secure and reliable currency exchange.

But Bitcoin users have few alternatives if they wish to convert their Bitcoins into more stable commodities. A recently-launched competitor, called TradeHill, has capitalized on Mt.Gox's troubles by encouraging members of the Bitcoin community to use their exchange instead. But the site is so new that no one knows if its administrators have the resources or technical expertise to avoid the security and reliability problems that have plagued Mt.Gox.

It's been a wild couple of months for Bitcoin traders. Between April and June, the currency rose from a dollar to more than $30. This month, it fell back to $10 and rose again to $20. It was at $17 at the beginning of this weekend before a string of bad news pushed it down again.

Theoretically, this weekend's developments shouldn't damage Bitcoin's long-term value, since the security model of the underlying currency remains uncompromised. But Bitcoin is a fiat currency; its value ultimately depends on nothing more than public confidence. If the recent string of Bitcoin-related security woes convinces more Bitcoin users to cash out, the currency's value could continue to fall.

June 15, 2011 at 5:30 pm in reply to: The States of the Union vs. the Territory

Alfred Adask hasn't proven that the “State” in federal law is a wholly owned subsidiary corporation of the federal government, but his beliefs are in agreement with this website. Throughout his writings and his AntiShyster news magazine, he only deals with things on a superficial level, which is why all he can do is speculate.

    http://famguardian.org/PublishedAuthors/Media/Antishyster/Antishyster.htm

The actual proof of his hypothesis lies in:

Corporatization and Privatization of the Government, Form #05.024

    FORMS PAGE: http://sedm.org/Forms/FormIndex.htm (OFFSITE LINK)

    DIRECT LINK: http://sedm.org/Forms/MemLaw/CorpGovt.pdf (OFFSITE LINK)

See, especially , section 12.3 of the above for the proof.

The reason that Adask has to speculate and can't prove his hypothesis is because:

    1. He doesn't understand franchises.

    2. He doesn't understand the law of property.

    3. He doesn't understand that “territory” includes property.

    4. He doesn't understand offices and agency.

    5. He doesn't understand that a “taxpayer” is an office created by the government that is owned by the government and therefore property.

    6. He doesn't understand that PROPERTY such as a public office can be situated within a federal district without the human being filling the office being domiciled within or physically situated in the district. Consenting to fill the office causes the volunteer to have an effective domicile on federal territory because representing an OFFICE that itself is domiciled on federal territory under Federal Rule of Civil Procedure 17(B ), 4 USC 72, 26 USC 7701(a)(39) and (a)(40).

    7. He doesn't understand that a statutory “U.S. citizen” is a franchise status that has nothing to do with one's domicile and which is an officer of the federal corporation. Those accepting the franchise volunteer for a federal office which is domiciled on federal territory.

    8. He doesn't understand that availing oneself of the “benefits” of said office constitutes consent to occupy the office and assume all the liabilities associated with said office under the common law.

    9. He doesn't understand that all statutory “States” under all federal law are actually federal corporations, and that those Constitutional states that avail themselves of the “benefits” of operating as a federal corporation, such as Social Security, Medicare, Driver licenseing, etc effectively consent to the obligations associated with being a federal territory.

Until Adask can prove all of the above as the SEDM sister website has already exhaustively done, he will always be suspected as a crackpot and the feds will never leave him alone. Knowledge and evidence are the only thing that will cause the freedom movement to move forward.

FEELINGS don't win cases. EVIDENCE does.

Adask blames the current situation on the fiat currency system and the Federal Reserve. That situation:

    1. Is the REASON they had to use franchises to enslave and subjugate everyone: To regulate the supply of fiat currency.

    2. Is NOT the VEHICLE by which the corruption was implemented. Franchises are the vehicle.

He points out Article 1, Section 10 of the Constitution and it is pivotal, but not for the reasons he indicates. All franchises are contracts between the grantor and the grantee. The problem is that most Americans consensually surrendered their sovereignty and are completely unaware how they did it. Until they understand how it was done, and that the mechanisms are unconstitutional, there will never be a remedy.

It appears to us that you aren’t doing your homework or following the mandatory Path to Freedom, or you wouldn’t need the help you are asking for. Are you following the mandatory Path to Freedom?

    http://sedm.org/Forms/Procs/PathToFreedom.pdf

    Some observations.

    1. Permanent address is one’s domicile. To remain outside of exclusive federal jurisdiction, it must be one of the following:

    1.1. None

    1.2 Heaven

1.3 A place that doesn’t have a government like the pacific ocean.

1.4 A constitutional but not statutory “State”, which is a legislatively but not constitutionally “foreign” state.

Your choice. That is covered in the following which you should read and reread several times:

Why Domicile and Becoming a Taxpayer Require Your Consent

    http://famguardian.org/Subjects/Taxes/Remedies/DomicileBasisForTaxation.htm

    2. Your spelling was very bad. Please proofread your posts because we had to fix a lot. It’s bad enough that we have to do your homework for you. Forcing us to proofread your posts and correct errors adds insult to injury.

    3. You asked for advice by using the words “should”, “okay”, and “I”. We can’t provide advice or condone any choice, but only provide law and facts and more than one option that is relevant. Please follow the techniques for asking questions. If you don’t, we will have to delete your future posts:

    http://sedm.org/Membership/GuideToAskingQuestions.htm

    4. Putting fifth amendment makes one look like they are committing a crime. Follow the procedures for filling out forms in the SEDM member agreement for filling out forms. They have it together:

    http://sedm.org/Membership/MemberAgreement.htm

    5. The amended form W-8BEN provided in the About IRS Form W-8BEN article is what we use. Fifth amendment for the signature is not appropriate.

    http://sedm.org/Forms/Tax/Withholding/W-8BEN/AboutIRSFormW-8BEN.htm

    6. We don’t fill in Part III of the W-8BEN. That is unnecessary. YOu should carefully read:

    6.1 IRS Pubs 515 and 54.

    6.2 Non-Resident Non-Person Position, Form #05.020

    http://sedm.org/Forms/MemLaw/NonresidentAlienPosition.pdf

..so you understand what everything is on the W-8BEN form. Only AFTER you have done that should you even consider posting questions in these forums. It appears that you haven’t done this and are needlessly cluttering these forums with questions you could have answered for yourself. DUE DILLIGENCE by all members is mandatory, as discussed in section 2 of the following:

    Guide to Asking Questions

    http://sedm.org/Membership/GuideToAskingQuestions.htm

This is NOT legal or tax advice, and it does NOT represent what you should or must do. It is what we would do in our own case. What you do is and continues to be entirely your choice and responsibility.

    _________

    Serfdom via Student Loans

The sharp attention being pointed toward higher education is important for a variety of reasons including the grim reality that we are facing another extraordinary bubble. Instead of blindly following into another credit fueled bubble we should probably pause as we cross the $1 trillion student loan threshold. The cost of education is becoming onerous and student loans are littered with financial landmines. Many are given to students to attend for-profit schools that will yield very little return on investment in the market aside from stockholders and corporate leaders. The uglier side also includes the inability to discharge student loans in bankruptcy. Americans have the ability to discharge mortgage debt if they are unable to pay their home payment. Businesses have the power to renegotiate contracts and loans with banks. Yet we somehow have managed to recreate debtor’s prison except it comes in the form of a student loan. Another dirty secret comes from the financial institutions gouging students with additional fees on top of the original loan balance. The higher education bubble is popping and the long-term implications loom large for our struggling economy.

Student loans creating a generation of serfs

One of the implicit tenets we live by in America is the ability to fail and comeback from setbacks. Currently this idea has been usurped by the giant financial organizations and has excluded virtually every other American. You have luxury hotels imploding and banks simply dishing billion dollar bad bets to the American taxpayer. At the core of the too big to fail bailouts is the notion that banks made horribly bad bets and needed to walk away. So they did by saddling the American taxpayer with the bill. Yet with student loans banks are lending to anyone and everyone willing to attend any questionable institution. The due diligence is comical and the corruption that is occurring is similar to the mortgage boiler rooms that were dishing out subprime loans to any person that walked in through the front door. The stories of student loan purgatory are starting to fill the internet. Take a look at this post from “Frank” over at Student Loan Justice:

“I graduated from law school in December of 97. I have paid on my student loans off and on over the past 9+ years and have paid back an estimated $75,000 on a loan that when I graduated was a little of $100,000. When I last checked the pay off amount it was over $135,000 and thats with paying $75,000 + over the past 9 years. I owe more on it now than when I took them out !! One of my loans is in default, they claim I owe them $23,000+ (which somehow jumped from $17,000 in a span of about 30 days) My two other lenders are close to defaulting and I am unsure if I should just let them default…”

This is one of the darker sides of student loans that are kept hidden by the banks and the government. Many lenders gouge students when they encounter problems. Unlike a credit card for example, when you have really extraordinary problems you have an exit hatch with bankruptcy. Ideally lenders are doing enough due diligence to learn their lesson. Yet with student loans the market keeps increasing as for-profit schools and other institutions increase tuition and saddle students like Frank above with insane amounts of loans. First, they have this person stuck in a modern day debtor’s prison. No way out. Next, they compound the misery by tacking on fee after fee. If Frank was unable to pay the initial amount what use is it adding more and more on top of it? The ugly side of the industry is they realize that they will have to milk the student as much as possible on the front-end. The government guarantees most loans so many lenders care not if a student really has any ability to pay the loan back in the future. These lenders quickly say, “well Frank shouldn’t have signed.” This cynical attitude is what is expected especially when the lender isn’t using his money. How about we ask the same lender to use their own money if they really feel many of these students warrant the current amount of loans being issued?

The acceleration and growth of student loan debt is incredible:

Student loan debt has long surpassed credit card debt but now is inching closer to $1 trillion. The bet is that by going to college a student will increase their earnings potential. The for-profits use multi-decade data on public and private institutions that actually show real increased earnings over a lifetime. This is true. Yet the for-profit machine is relatively new. They tout the earnings potential of a college degree even though they are selling a glorified piece of paper for tens of thousands of dollars with no measurable results for that specific institution. The result is you have a two-tier system developing with graduates; you have those that went to reputable schools and those who got conned:

“(Miami Hearld) It’s been a year since 23-year-old Carlos Tejero graduated Kaiser University with an associate’s degree in nuclear medicine. He’d been working in retail and as an insurance salesman for some six years before then, so he has some work experience, too. But Tejero is still unemployed, and all the while, the money he took out to pay for his degree is building interest. Tejero is loaded with $18,000 in student debt.“For people who are serious about their education, there’s really no other option,” he said.”

The mentality of “education at any cost” is one that is surging out of control and is a bubble that is fully in season but is also starting to bust:

The cost of going to college has outpaced every category of living by a very wide margin. It is hard to believe but the cost of college has even surpassed the now historic housing bubble. How can this be? You have a perfect combination of:

    -Un-regulated casino like financial sector

-Government bought out by financial sector and used as a dumping ground

-A myth that any college is a good college

-A marketing and propaganda machine that is actively destroying the middle class

Add this all into the mix and you have the current environment. It is unfortunate because having a strong educated workforce is something that we should pride ourselves in. Instead of focusing funds on producing intelligent and knowledgeable individuals the financial sector and government are simply trying to increase the graduate count even if it means hundreds of thousands are coming out of schools with no measurable gain in knowledge. We are seeing now an army of unemployed college graduates:

This is a record level still and the above chart hides the fact that many graduates are underemployed in a field not utilizing their skill set.

“(eCollegeTimes) Tiffany Groene is waiting tables.

Erin Crites is making lattes and iced coffees.

And Anna Holcombe is buying and selling gold.

These three women share more than just scraping by with low-paying jobs: They all have master’s degrees and are unable to find work in their specialty areas.

There’s even a name for their situation. They are referred to as mal-employed, a term coined in the ’70s for college graduates who could not find jobs that require a degree. Instead, they settle for low-skilled jobs.”

The big difference between now and the 1970s is that these “mal-employed” workers are being hounded by the albatross of student loan debt. It is interesting that every other item of consumer debt has contracted strongly except that of student loans:

This really isn’t surprising given that our current crony financial system is bent on sucking every nickel and dime out of the working and middle class. They don’t care that students are being taken for a ride. Many of these “colleges” set up shop in empty commercial buildings and suddenly are open for business. It is amazing that anything Wall Street has gotten its hands on it has turned into a giant bubble. Take housing for example. Prior to the casino era homes were rather boring investments and people actually built solid equity in their homes. That all changed as we know once the too big to fail banks got involved. The same is happening in education. There is no doubt that we have great institutions in the market. Yet the amount of subprime institutions is astounding and many are being sucked into this troubling trap.

What is fascinating is that the vampire financial system might have found a backdoor at robbing people from their Social Security:

“(Valley Advocate) They get 25 cents on the dollar—on average they get $123,000 back from the borrower on a student loan for $100,000. There’s no statute of limitations. … Sallie Mae often brags that they can predict very accurately who is going to default. They treat the people they predict will default much worse. They don’t grant them forbearances. At the root of it is [lack of] bankruptcy protections, which enables the whole system to start cycling up in this predatory fashion.”

Wish number two, Collinge says, is that the system would stop garnishing people’s Social Security. “I’ve gotten submissions [for the Student Loan Justice website] from senior citizens who couldn’t buy medications as a result of a percent of their income going for their loans,” he says.”

What an incredible mess. Using a college degree to saddle hundreds of thousands with insurmountable levels of debt. Is this really what we want from our education system?

    Communist Manifesto review

If you think Communism (or collectivism) was destroyed, please consider the following:

    MARXISM 101:

COMMUNISM – the ownership of property, or means of production, distribution and supply, by the whole of a classless society, with wealth shared on the principle of 'to each according to his need', each yielding fully 'according to his ability'.

    – – – Webster's Dictionary.

SOCIALISM – A political and economic theory advocating collective ownership of the means of production and control of distribution. It is based upon the belief that all, while contributing to the good of the community, are equally entitled to the care and protection which the community can provide.

    — Webster's dictionary

Socialism and communism = COLLECTIVE ownership.

    From the Communist manifesto:

“In this sense, the theory of the Communists may be summed up in the single sentence: Abolition of private property.”

But American law protects private property

    Amendment V, US Constitution 1789

… nor shall private property be taken for public use, without just compensation.

Communism, Socialism, and Marxism abolish private property ownership and replaces it with collective ownership, with the superior rights in the State.

There can be no “peaceful co-existence”. Either you're for the individual's right to absolutely own private property or you're for the collective.

Ten Planks of the Communist Manifesto

    1. Abolition of private property and the application of all rent to public purpose.

The fraudulent substitution of qualified ownership of estate in place of absolute ownership of private property has accomplished that task. The ad valorem tax on estate is basically “rent” charged by the State. The 14th Amendment U.S. citizen cannot have a domicile in the U.S.A., and various zoning, school & property taxes only apply to estate. Also the Bureau of Land Management is another instrumentality that supports this plank.

    2. A heavy progressive or graduated income tax.

The 16th Amendment of the U.S. Constitution, 1913, The Social Security Act of 1935.; Joint House Resolution 192 of 1933; and various State “income” taxes. Remember, government is limited to taxing privileges, not rights, so you have to discover that the privilege to “discharge” debt without paying lawful money is behind the “tax” on all incomes, regardless of the source or apportionment.

We now call it “paying your fair share”.

    3. Abolition of all rights of inheritance.

We call it Federal & State estate Tax (1916); reformed Probate Laws, and limited inheritance via arbitrary inheritance tax statutes.

This also conflicts with the Bible:

A good man leaveth an inheritance to his children's children…

    Proverbs 13:22

Ye shall not afflict any widow, or fatherless child.

    Exodus 22:22

And oppress not the widow, nor the fatherless…

    Zechariah 7:10

    4. Confiscation of the property of all emigrants and rebels.

    We call in government seizures, tax liens, Public “law” 99-570 (1986);

Executive order 11490, sections 1205, 2002 which gives private land to the Department of Urban Development; the imprisonment of “terrorists” and those who speak out or write against the “government” (1997 Crime/Terrorist Bill); or the IRS confiscation of property without due process.

    5. Centralization of credit in the hands of the State, by means of a national bank with state capital and an exclusive monopoly.

We call it the Federal Reserve which is a credit/debt system nationally organized by the Federal Reserve act of 1913. All local banks are members of the Fed system, and are regulated by the Federal Deposit Insurance Corporation (FDIC).

Technically speaking, we're under control of the usurer / collectivist alliance.

    6. Centralization of the means of communication and transportation in the hands of the State.

We call it the Federal Communications Commission (FCC) and Department of Transportation (DOT) mandated through the ICC act of 1887, the Commissions Act of 1934, The Interstate Commerce Commission established in 1938, The Federal Aviation Administration, Federal Communications Commission, and Executive orders 11490, 10999, as well as State mandated driver's licenses and Department of Transportation regulations.

The loss of inalienable rights (natural and personal liberty) follow the surrender of private property rights.

    7. Extension of factories and instruments of production owned by the State, the bringing into cultivation of waste lands, and the improvement of the soil generally in accordance with a common plan.

Corporations are creatures of government, and only exist by its permission. This plank is further enforced by the Desert Entry Act and the Department of Agriculture. As well as the Department of Commerce and Labor, Department of Interior, the Environmental Protection Agency, Bureau of Land Management, Bureau of Reclamation, Bureau of Mines, National Park Service, and the IRS control of business through corporate regulations.

    8. Equal liability of all to labor. Establishment of Industrial armies, especially for agriculture.

Note – this is not to be confused with the “right to labor” and the “right to payment.” We call it the enforced labor for the benefit of another – aka Social Security. This plank is further enforced by the Department of Labor. The National debt and inflation caused by the communal bank has caused the need for a two “income” family. Women in the workplace since the 1920's, the 19th amendment of the U.S. Constitution, the Civil Rights Act of 1964, assorted Socialist Unions, affirmative action, the Federal Public Works Program and of course Executive order 11000.

    9. Combination of agriculture with manufacturing industries; gradual abolition of the distinction between town and country by a more equable distribution of the population over the country.

We call it agribusiness and corporate farming, and the Planning Reorganization act of 1949 , zoning (Title 17 1910-1990) and Super Corporate Farms, as well as Executive orders 11647, 11731 (ten regions) and Public “law” 89-136.

    10. Free education for all children in government schools. Abolition of children's factory labor in its present form. Combination of education with industrial production, etc. etc.

Though child labor that directly benefited families is abolished, child labor that benefits the state is permitted (as in “entertainment” – part of the propaganda ministry). People are being taxed to support what we call 'public' schools, which train the young to work for the communal debt system. We also call it the Department of Education, the NEA and Outcome Based “Education” .

    Capitalist Principles

CAPITALISM – An economic system in which the means of production, distribution and exchange are privately owned and operated for private profit.

    – – – WEBSTER'S DICTIONARY

PRIVATE PROPERTY – “As protected from being taken for public uses, is such property as belongs absolutely to an individual, and of which he has the exclusive right of disposition. Property of a specific, fixed and tangible nature, capable of being in possession and transmitted to another, such as houses, lands, and chattels.”

    – – – Black's Law dictionary, sixth ed., p.1217

If you concatenate capitalism with private property, you can see the “inconvenient truth”.

Capitalism is an economic system in which the means of production, distribution and exchange are absolutely owned by individuals and operated for their individual profit.

A farmer who absolutely owns his farm is a true capitalist.

A farmer who does not, is a tenant.

A worker who absolutely owns the fruits of his labor is a true capitalist.

A worker who does not, is a serf.

“No one should suffer because they lack {fill in the blank}” should be prefaced with “No one should be compelled to labor for the benefit of another, so that…” because slavery is not an acceptable solution to the ills of mankind.

If you oppose slavery and theft by government, you are anti-socialist.

Under the republican form of government, your inalienable rights are secure.

However, by your consent, and enrollment into Social Security, your birthright and endowment of your Creator was surrendered, and replaced with the government granted privileges and obligations commensurate with your new status as a “Socialist Serf”.

China Calls US Culprit in Global 'Internet War'

    BEIJING June 3, 2011 (AP)

The Chinese military accused the U.S. on Friday of launching a global “Internet war” to bring down Arab and other governments, redirecting the spotlight away from allegations of major online attacks on Western targets originating in China.

The accusations Friday by Chinese military academy scholars, and their urging of tougher policing of the Internet, followed allegations this week that computer hackers in China had compromised the personal Gmail accounts of several hundred people, including government officials, military personnel and political activists.

Google traced the origin of the attacks to the city of Jinan that is home to a military vocational school whose computers were linked to a more sophisticated assault on Google's systems 17 months ago. China has denied responsibility for the two attacks.

Writing in the Communist Party-controlled China Youth Daily newspaper, the scholars did not mention Google's claims, but said recent computer attacks and incidents employing the Internet to promote regime change in Arab nations appeared to have originated with the U.S. government.

“Of late, an Internet tornado has swept across the world … massively impacting and shocking the globe. Behind all this lies the shadow of America,” said the article, signed by Ye Zheng and Zhao Baoxian, identified as scholars with the Academy of Military Sciences.

“Faced with this warmup for an Internet war, every nation and military can't be passive but is making preparations to fight the Internet war,” it said.

While nuclear war was a strategy of the industrial era, Internet war is a product of the information age, the article said. Such conflicts stand to be hugely destructive, threatening national security and the very existence of the state, it said.

China needs to “express to the world its principled stance of maintaining an 'Internet border' and protecting its 'Internet sovereignty,' unite all advanced forces to dive into the raging torrent of the age of peaceful use of the Internet, and return to the Internet world a healthy, orderly environment,” the article said.

China already heavily filters content and blocks numerous foreign websites, a system known as the “Great Firewall of China.” The police employ a large force of Internet monitors to scour the Web for content deemed illegal or subversive, and those users transmitting sensitive contact can be charged with sedition or other crimes.

A number of foreign governments say they've been targeted by hacking attacks from China, although Beijing routinely denies undertaking such operations and says it too is a victim of such activity.

Secretary of State Hillary Rodham Clinton told reporters attacks such as the one alleged by Google were a primary reason why the State Department had for the first time created a cyber-security coordinator.

The FBI said it was investigating Google's allegations, but no official government email accounts have been compromised. Google said all the hacking victims have been notified and their accounts have been secured.

    Cyber Combat: Act of War

Pentagon Sets Stage for U.S. to Respond to Computer Sabotage With Military Force.

Article Video Comments (185) more in Tech ».

By SIOBHAN GORMAN And JULIAN E. BARNES

WASHINGTON—The Pentagon has concluded that computer sabotage coming from another country can constitute an act of war, a finding that for the first time opens the door for the U.S. to respond using traditional military force.

WSJ's Siobhan Gorman has the exclusive story of the Pentagon classifying cyber attacks by foreign nations as acts of war.

    Photo: THOMAS KIENZLE/AFP/Getty Images

The Pentagon's first formal cyber strategy, unclassified portions of which are expected to become public next month, represents an early attempt to grapple with a changing world in which a hacker could pose as significant a threat to U.S. nuclear reactors, subways or pipelines as a hostile country's military.

In part, the Pentagon intends its plan as a warning to potential adversaries of the consequences of attacking the U.S. in this way. “If you shut down our power grid, maybe we will put a missile down one of your smokestacks,” said a military official.

Recent attacks on the Pentagon's own systems—as well as the sabotaging of Iran's nuclear program via the Stuxnet computer worm—have given new urgency to U.S. efforts to develop a more formalized approach to cyber attacks. A key moment occurred in 2008, when at least one U.S. military computer system was penetrated. This weekend Lockheed Martin, a major military contractor, acknowledged that it had been the victim of an infiltration, while playing down its impact.

The report will also spark a debate over a range of sensitive issues the Pentagon left unaddressed, including whether the U.S. can ever be certain about an attack's origin, and how to define when computer sabotage is serious enough to constitute an act of war. These questions have already been a topic of dispute within the military.

One idea gaining momentum at the Pentagon is the notion of “equivalence.” If a cyber attack produces the death, damage, destruction or high-level disruption that a traditional military attack would cause, then it would be a candidate for a “use of force” consideration, which could merit retaliation.

The Pentagon's document runs about 30 pages in its classified version and 12 pages in the unclassified one. It concludes that the Laws of Armed Conflict—derived from various treaties and customs that, over the years, have come to guide the conduct of war and proportionality of response—apply in cyberspace as in traditional warfare, according to three defense officials who have read the document. The document goes on to describe the Defense Department's dependence on information technology and why it must forge partnerships with other nations and private industry to protect infrastructure.

The strategy will also state the importance of synchronizing U.S. cyber-war doctrine with that of its allies, and will set out principles for new security policies. The North Atlantic Treaty Organization took an initial step last year when it decided that, in the event of a cyber attack on an ally, it would convene a group to “consult together” on the attacks, but they wouldn't be required to help each other respond. The group hasn't yet met to confer on a cyber incident.

Pentagon officials believe the most-sophisticated computer attacks require the resources of a government. For instance, the weapons used in a major technological assault, such as taking down a power grid, would likely have been developed with state support, Pentagon officials say.

The move to formalize the Pentagon's thinking was borne of the military's realization the U.S. has been slow to build up defenses against these kinds of attacks, even as civilian and military infrastructure has grown more dependent on the Internet. The military established a new command last year, headed by the director of the National Security Agency, to consolidate military network security and attack efforts.

The Pentagon itself was rattled by the 2008 attack, a breach significant enough that the Chairman of the Joint Chiefs briefed then-President George W. Bush. At the time, Pentagon officials said they believed the attack originated in Russia, although didn't say whether they believed the attacks were connected to the government. Russia has denied involvement.

The Rules of Armed Conflict that guide traditional wars are derived from a series of international treaties, such as the Geneva Conventions, as well as practices that the U.S. and other nations consider customary international law. But cyber warfare isn't covered by existing treaties. So military officials say they want to seek a consensus among allies about how to proceed.

“Act of war” is a political phrase, not a legal term, said Charles Dunlap, a retired Air Force Major General and professor at Duke University law school. Gen. Dunlap argues cyber attacks that have a violent effect are the legal equivalent of armed attacks, or what the military calls a “use of force.”

“A cyber attack is governed by basically the same rules as any other kind of attack if the effects of it are essentially the same,” Gen. Dunlap said Monday. The U.S. would need to show that the cyber weapon used had an effect that was the equivalent of a conventional attack.

James Lewis, a computer-security specialist at the Center for Strategic and International Studies who has advised the Obama administration, said Pentagon officials are currently figuring out what kind of cyber attack would constitute a use of force. Many military planners believe the trigger for retaliation should be the amount of damage—actual or attempted—caused by the attack.

For instance, if computer sabotage shut down as much commerce as would a naval blockade, it could be considered an act of war that justifies retaliation, Mr. Lewis said. Gauges would include “death, damage, destruction or a high level of disruption” he said.

Culpability, military planners argue in internal Pentagon debates, depends on the degree to which the attack, or the weapons themselves, can be linked to a foreign government. That's a tricky prospect at the best of times.

The brief 2008 war between Russia and Georgia included a cyber attack that disrupted the websites of Georgian government agencies and financial institutions. The damage wasn't permanent but did disrupt communication early in the war.

A subsequent NATO study said it was too hard to apply the laws of armed conflict to that cyber attack because both the perpetrator and impact were unclear. At the time, Georgia blamed its neighbor, Russia, which denied any involvement.

Much also remains unknown about one of the best-known cyber weapons, the Stuxnet computer virus that sabotaged some of Iran's nuclear centrifuges. While some experts suspect it was an Israeli attack, because of coding characteristics, possibly with American assistance, that hasn't been proven. Iran was the location of only 60% of the infections, according to a study by the computer security firm Symantec. Other locations included Indonesia, India, Pakistan and the U.S.

Officials from Israel and the U.S. have declined to comment on the allegations.

Defense officials refuse to discuss potential cyber adversaries, although military and intelligence officials say they have identified previous attacks originating in Russia and China. A 2009 government-sponsored report from the U.S.-China Economic and Security Review Commission said that China's People's Liberation Army has its own computer warriors, the equivalent of the American National Security Agency.

That's why military planners believe the best way to deter major attacks is to hold countries that build cyber weapons responsible for their use. A parallel, outside experts say, is the George W. Bush administration's policy of holding foreign governments accountable for harboring terrorist organizations, a policy that led to the U.S. military campaign to oust the Taliban from power in Afghanistan.

    The War on Cyber Attacks

Attacks of varying severity have rattled nations in recent years.

June 2009: First version of Stuxnet virus starts spreading, eventually sabotaging Iran's nuclear program. Some experts suspect it was an Israeli attempt, possibly with American help.

November 2008: A computer virus believed to have originated in Russia succeeds in penetrating at least one classified U.S. military computer network.

August 2008: Online attack on websites of Georgian government agencies and financial institutions at start of brief war between Russia and Georgia.

May 2007: Attack on Estonian banking and government websites occurs that is similar to the later one in Georgia but has greater impact because Estonia is more dependent on online banking.
