The COVID-19 Stimulus SCAM
4/23/2020
As many of you know, during April 2020, at the height of the Covid-19 pandemic, the national government offered a stimulus check of $1,000 allegedly for every American, but this is simply not the case. This article will talk about why it is really only a franchise “benefit” of those who are statutory “taxpayers”, and why what they are paying you is ACTUALLY your OWN MONEY!
We were introduced to the subject when we noticed two MSN articles on who is eligible for the “benefit” check.
- 5 Groups of people who won’t get a coronavirus aid payment
- 3 Groups of People who Won’t Get a Stimulus Check
The first article above says the following about who is NOT eligible:
3. Most noncitizens
According to data from the U.S. Census Bureau’s American Community Survey between 2008 and 2018 via the Kaiser Family Foundation, there are about 21.7 million non-citizens living in the United States, of which between 16 million and 17 million are most likely adults aged 18 and older. For many of these non-citizens who don’t have a valid Social Security number, no payout awaits. This also excludes undocumented immigrants from receiving a $500 payout per child, assuming their children aged 16 and under are American citizens. The exception to the rule is green-card holders. These people, who have a legal pathway to permanent residence in the United States, are likely to receive an Economic Impact Payment.
3. Anyone who doesn’t have a Social Security number
In most cases, you must have a valid Social Security number in order to receive any stimulus money. In addition, if you’re married to someone who does not have a Social Security number and you’re filing taxes jointly, neither of you will generally be eligible to collect a stimulus check. But there is an exception to that second rule for married couples in which at least one spouse is a member of the military and at least one spouse has a Social Security number.
The stimulus checks can provide much-needed relief for millions of families who have experienced significant financial hardship due to COVID-19. But before you start planning how you’re going to spend your bonus money, double-check that you qualify for the stimulus check. https://www.congress.gov/bill/116th-congress/senate-bill/3548/text
Below is the pertinent text of the above act:
DIVISION B—RELIEF FOR INDIVIDUALS, FAMILIES, AND BUSINESSES
TITLE I—REBATES AND OTHER INDIVIDUAL PROVISIONS
SEC. 2101. 2020 RECOVERY REBATES FOR INDIVIDUALS.(a) IN GENERAL.—Subchapter B of chapter 65 of subtitle F of the Internal Revenue Code of 1986 is amended by inserting after section 6427 the following new section:
“SEC. 6428. 2020 RECOVERY REBATES FOR INDIVIDUALS.
“(a) IN GENERAL.—In the case of an eligible individual, there shall be allowed as a credit against the tax imposed by subtitle A for the first taxable year beginning in 2020 an amount equal to the lesser of—“(1) net income tax liability, or
“(2) $1,200 ($2,400 in the case of a joint return).“(b) SPECIAL RULES.—
“(1) IN GENERAL.—In the case of a taxpayer described in paragraph (2)—
“(A) the amount determined under subsection (a) shall not be less than $600 ($1,200 in the case of a joint return), and
“(B) the amount determined under subsection (a) (after the application of subparagraph (A)) shall be increased by the product of $500 multiplied by the number of qualifying children (within the meaning of section 24(c)) of the taxpayer.
“(2) TAXPAYER DESCRIBED.—A taxpayer is described in this paragraph if the taxpayer—
“(A) has qualifying income of at least $2,500, or
“(B) has—“(i) net income tax liability which is greater than zero, and
“(ii) gross income which is greater than the basic standard deduction.
An “eligible individual” is not defined as a taxpayer in (e ) 3.
And the “special rules” of (b) only apply to a “taxpayer described”.
And if you have no “tax imposed by subtitle A for the first taxable year beginning in 2020”, then there is a “credit” against essentially zero, with the (credit) “amount equal…to” $1200.—which means they owe you.
(Depends of course how they define individual)
The catch is (h) 1) “identification number requirement” where a stipulation for NO credit is …
”who does not include on the return of tax for the taxable year [an identification number (SSN)”.
I’ve been wondering how they get around issuing checks to people on SS with no requirement to file. I suspect the latter is why, on the online non-filer portal, that the IRS is using a contract-company to automatically fill in portions of a 1040 form before it hits their doorstep.
Not sure there is any way around the ID number requirement section.
We smell opportunity in the way of an admission via a mailing–fill out no return and state so, tell them you had an SSN applied for by your parents without your consent with the number owned by the SSA as xxx-xx-xxxx, tell them that since you didn’t have a taxable year, you’re not entitled to a “credit”, and non-payment will be taken as an admission.
Sounds like a “Cares Act” “NO CREDIT” “Recovery Rebate” Form. Ha ha ‘As an “eligible individual” with NO requirement to file “a return of tax for the taxable year”, and considering laws prevent the filing of returns based on falsehoods (such as a return when no return is required), I am entitled to “no credit” even though the SSA owns the “social security number” XXX-XX-XXXX. An issuance of “NO CREDIT” under Cares Act Sect 6428.2020 will be taken as an admission.
So the bottom line is that you can’t receive a stimulus check UNLESS you have a Social Security Number and are a “taxpayer”. If you aren’t either one of these because you are PRIVATE, the government can’t pay you ANYTHING. This is a direct result of the fact that the U.S. Supreme Court held that it is an abuse of the government’s taxing power to pay PUBLIC money or tax money to PRIVATE people.
To lay, with one hand, the power of the government on the property of the citizen, and with the other to bestow it upon favored individuals to aid private enterprises and build up private fortunes, is none the less a robbery because it is done under the forms of law and is called taxation. This is not legislation. It is a decree under legislative forms.
Nor is it taxation. ‘A tax,’ says Webster’s Dictionary, ‘is a rate or sum of money assessed on the person or property of a citizen by government for the use of the nation or State.’ ‘Taxes are burdens or charges imposed by the Legislature upon persons or property to raise money for public purposes.’ Cooley, Const. Lim., 479.
Coulter, J., in Northern Liberties v. St. John’s Church, 13 Pa. St., 104 says, very forcibly, ‘I think the common mind has everywhere taken in the understanding that taxes are a public imposition, levied by authority of the government for the purposes of carrying on the government in all its machinery and operations—that they are imposed for a public purpose.’ See, also Pray v. Northern Liberties, 31 Pa.St., 69; Matter of Mayor of N.Y., 11 Johns., 77; Camden v. Allen, 2 Dutch., 398; Sharpless v. Mayor, supra; Hanson v. Vernon, 27 Ia., 47; Whiting v. Fond du Lac, supra.”

The regulations at 26 CFR 301.6109-1 state that SSNs are only required for those engaged in a “trade or business”, meaning a public office WITHIN the U.S. Inc federal corporations. The SSN is being used as what the FTC calls a “franchise mark”, and if you aren’t a franchisee and instead are PRIVATE and protected by the Constitution, then you can’t receive the damn check! See:
About SSN and TINs on Government Forms and Correspondence, Form #05.012
STATUTORY “U.S. citizens” are fictions of law and offices within the government. See:
Why You are a “national”, “state national”, and Constitutional But not Statutory Citizen
Private people are NOT statutory “U.S. citizens” or “nonresident aliens engaged in the trade or business franchise”. Hence, they can’t use SSNs or TINs and are not eligible for coronavirus checks.
Further, we recently wrote an article on how PRIVATE, non-filers can apply for the stimulus check:
https://famguardian.org/non-filers-enter-payment-info-here-irs/
You can’t apply without an SSN, and the information you provide will be used to link UNENUMERATED accounts to the SSN so that they can use it to STEAL and enforce against you later. Watch out!
