I’m posting an update to this thread.

 

My mother, for whom I was specifically looking this up, has faced a significant series of tax issues thanks to her initial accountant for her business.

 

After years of nothing, the IRS finally got aggressive – this was the first time they started taking money directly from her bank account (they had been levying the SS checks).

 

In the meantime, before and currently, one of my brothers is a lawyer and is working to get her tax situation completely resolved.  Yes, she’ll be paying the IRS (which really irriates me, but, not my decision).

 

So, she has deferred to his advice regarding whether to pursue the 6331 NOTICE OF LEVY that the bank received.  He said, given the bigger picture, not to bother with that and just keep working to get the whole thing resolved.

 

He also is of the opinion that the 6331(a) “to whom” clause is not exclusive.  I don’t share that opinion.

 

I wouldn’t have rolled over like that of course, it just allows the IRS to keep doing their illegal BS.

 

Thank you for your help – I really appreciate it and I’ve now got more “tools in my toolbox.”
