Thanks for the quick response. I did indeed use this form. I might be misunderstanding its use. The post office here says they no longer have a notary on duty. So I've been thrown for a loop there.
The way I used this before was just having the bank teller notarize everything I sign in the documents, make copies and then have another person at the bank sign as the mailer, put everything in the envelopes and then mailed it myself.
I understand it now that I should just sign all the documents, have them notarized; have the mailer sign the certificate of service, inspect contents, and have their signature notarized on the certificate of service; then make copies of everything, mail the copies of the documents and certificate of service certified mail return reciept but not restricted…essentially just addressed to the persons office so that someone can sign for them. Please correct me if I am wrong here. It seems the return reciept may actually be uneccessary. I only need proof that I sent it to the place where the addressee could recieve it, right?
I'm kind of interested now what is to become of the mail I sent certified and restricted. I think sending restricted was my main mistake. It says it is coming back to me, I doubt a refund is involved. It's just a bit odd to me that this would be returned, maybe the addressee refused it or was on vacation.
Any ideas for a Postal Annex that has both persons on duty? Maybe FedEx/Kinkos? The UPS Stores do not send certified mail or have a notary. Pretty sure that if I can find a place with both parties on duty this will get taken care of properly. Thanks again.

I just watched this nonsense on google video. It was a good laugh.

Any news on this? I am looking into applying for a passport. I have prepared a modified form but after reading all this I am rethinking that plan as I have changed the oath statement. This is starting to digust me that the State department is calling it a US passport in their replies! Even worse that they reply back stating these attempts go against the constitution and court cases! What are these people smoking!?
It seems the best way to get the job done is just edit everything but the oath statement and handwrite in a reference to the attached affidavit. I just don't want to end up with a document that wrongly states my allegiance. Something is seriously wrong when the government cannot even recognize its own positively enacted law. This is starting to frustrate me.

Be careful!? You can't use the phrase “my SSN” as you did and use this website.? 20 CFR 422.103(d) says the SSN belongs to the Social Security Administration, and NOT the person using it.? To say “my SSN” therefore implies that you work for the Social Security Administration and are visiting here on official business, in which case you are a “taxpayer”.? Do your homework FIRST before you start filling out government forms and digging DEEP holes for yourself.

People who are careless with language, especially on government or legal forms, make good hosts for government parasites.? Shape up or ship out. Words mean EVERYTHING and they can enslave you if you use them incorrectly.? Don't EVER describe any government issued number as “my number” or the Admin will ban you from this forum and blacklist you because you are a “taxpayer” and we can't allow “taxpayers” to use anything on this website.? That's a requirement of the Disclaimer.? Read and heed!
My apologies, this won't happen again. This was a careless mistake. I do understand it is not my SSN and is actually “public property” or otherwise owned by the government. I am working towards detaching myself from this number. I've been brainwashed for too long into thinking it is mine. Thanks for reminding me of this. I will make sure to remind this employer of this fact as well when I make reference to the number.
Author #5 wrote on Apr 3 2007, 07:58 PM:As far as the false W-9 you gave them, simply provide a W-8BEN or affidavit of citizenship, domicile, and tax status and then serve upon them a correspondence indicating that it was FALSE and was submitted by mistake.?http://sedm.org/Forms/Tax/W-8BEN/AboutIRSFormW-8BEN.htm
Serve the correspondence via certified mail with a Certificate of service so you have legal evidence that they were notified.

[post=”3760″][/post]I think I've got this figured out now. I've made sure to inform them in my cover letter that the W-9 was filled out incorrectly and that I am not the “US Person” or resident alien it refers to nor am I a resident of the United States ie. the District of Columbia and thus the form is invalid, null and void and is to be destroyed and all information contained in their systems removed. Thanks again for helping me clear this up.

Ok after reading up in Federal and State Withholding Options for Private Employers pamphlet it seems that the W-9 is to only be used by aliens! This is pretty upsetting that this employer would use this form to coerce a SSN from me when the IRC states this form is not to be used for even U.S. Citizens which I would assume they would assume that I am first. Heh, shows how much they know. Nevertheless, I am a nonresident alien so W-8-BEN should be used….I suppose in my letter to them I will explain their improper use of W-9 because I am not an alien and then proceed to explain that they do not need my SSN for any reason and that I do not consent to its use. However, the question is now….how do I revoke my coerced statement under penalty of perjury that I certified on this W-9? Or should I just tell them its null and void because I am not an alien but instead a nonresident alien?

Sir, when you state in your lead post above, Form W-9, do you mean the pesky form I-9?
It has been many, many years since I paid any income taxes, so I would have to go and look up what an IRS Form W-9 is, I just can not recall what that form is right now.

[post=”3757″][/post]Bing, thanks! I have been trying to locate information at sedm as well and that is where I found the amended W-9 form. Also interestingly enough the IRS has not updated this form since November 2005 and I signed it (under duress and ignorance) in November 2006. But to answer your question it is the form titled “Request for Taxpayer Identification Number and Certification”. I of course am not a taxpayer or at least if I ever claimed I was I'm fighting to revoke that status!
I am not certain that I need to include an amended or substitute version of this form to this employer as long as they understand my affidavit and W-8-BEN but I just want to be sure that I explain to them properly that they need to shred the W-9 and no longer use it or my SSN. Just trying to feel out the proper language to use in order to effectively communicate them. But like I said before I'm not sure if I need to include the substitute or amended to them but instead just use the 1099 letter from famguard as a framework to tell them to stop using my SSN and move on to amend the 1099 based on the affidavit and W-8-BEN….the W-9 I found at sedm was quite confusing and the one at famguard was especially confusing on the 2nd page.

And the other at famguard: http://famguardian.org/TaxFreedom/Forms/Em…SSNProvided.pdf
Thanks.
