First, I am actually surprised they used “United States of America”.
Secondly, I would say that the two principles definitely apply. HOWEVER and this is a big however (and I also wish you the best of luck) it will not be easy to explain that to a DMV director let alone a high school educated clerk. On top of that he doesn't care what the law says but only what the policy and procedures of the DMV are.
My suggestion, if you elect to pursue this route, is to at least establish a dialogue with someone high up the chain, such as a legal professional with the Texas Dept of Transportation.
They have a similar affidavit in Arizona for DL and other professional licenses. The problem is that most people have signed up for SSN. If your friend signs that form and submits it I guarantee that they will deny him on grounds that he lied and in fact has been assigned a SSN. On top of that, he risks being penalized for “committing perjury”.
Good luck with trying to explain to some poor soul at the DMV or a (presumptuous) manager that you wish to obtain a driver license as a private citizen without the use of public property (SSN) in the process. You might as well be speaking chinese.
Someone tried explaining to the payroll manager that one cannot be a federal resident and a state resident at the same time. One can only reside on one of those mutually exclusive territories. Sounds simple right? Well the lady was as confused as if she was being explained the string theory. Needless to say that someone did not succeed.
But what if someone who mistakenly applied for a SSN due to ignorance on his part and was assigned a number already applied again, this time documenting his true status as a private nonresident alien? And what if the SS Administration denied that private citizen because of non resident status elected on the application form? Could that denial letter be used as proof that one no longer qualifies for a SSN satisfying…..

I am in the process of learning the proper way to apply as a national since I was just naturalized not long ago. As I learn and find out from personal experiences I will keep you posted.

Also, I wasn't asking about the Statutes at Large in my second post. Instead it was about the United States Code texts and if it contains side margin notes/references kind of like the Statutes at Large do when you look at the scanned .pdf format.
It seemed like a good idea to ask someone who may know what it looks like instead of driving 20miles to find out myself. Losing 2hrs to find that out hardly seems like doing my “due diligence”.
I simply posted in this forum hoping someone who looked at the actual texts containing title of USC will let me know and save me a 2hr trip. And i surely didn't mean for you to do any of my research for me.

That is what I needed very much.
Would it be more helpful to look at the actual books in a law library? Do they have the Statute at Large note next to the actual section of USC that was derived from it or are the notes still at the end all mixed together?
If you are not sure what I mean, I am thinking of a sidenote kind of like when you look at the Statutes at Large and they have notes in the margins explaining what that paragraph/section pertains to or the date it was passed.

I have been following this conversation for a while and if I understand what Neo was trying to say I would like to clear this for you. Neo, feel free to correct me if I am mistaken.
I think he never meant to say that a state domiciled nonresident national is electing to become a permanent resident or that he is eligible to do so but simply that if one applies for the privilege of working for the feds by occupying an office and is authorized to do so, he may be granted a SS#.

In Arizona you can actually get your RN license without the SSN. All it takes is signing and affidavit that you don't have one. Since I suppose you have one and couldn't in good fait sign that affidavit you need to follow the “Start Here” path and get rid of it first.
I know you meant no disrepect and my reply was not aimed at you. It was more a response in general to a tragedy that, as you have pointed out, gets abused to promote personal agendas.
I must comment on the mention of 'holocaust'. I always do, sometimes to my injury.
The 'holocaust' is not only about jews. It bothers me immensly when I hear people refer to 'holocaust' as being something that was done against jews only and specifically. This just isn't the case. Many scholars have actually come forward and stated that there were millions of other ethnic groups that were in those camps. I have second hand knowledge (grandparents) that more than half of people in those camps were not jewish. In fact, middle class jews got preferential treatment.
Then there are scholars that argue against the true nature 'holocaust'. I won't be disrespectful to people who had family perish during that time so I won't comment on that. Feel free to investigate for yourself. I will have to say that it is a fact that Israel was created and given to jews shortly after the 'holocaust'. Cui bono?

I’ve been thinking about the mortgage and how to proceed for quite some time. I’ve talked to quite a few ‘professionals’ (never passing an opportunity to drill them with questions) to make sure that I understand what this process entails from their perspective.
In a hypothetical scenario, let’s assume that there is a (fictional) bank out there that is just happy to give you a loan without a SSN. Let’s also assume that the debtor (mortgagee) had a credit history through some credit cards, previous loans, rent, bills etc, all without ever volunteering or possessing a SSN.
It seems to me, from what I understood throughout my interviews of the ‘professionals’, that the mortgage/debt is going to be recorded on your credit report. It is also my understanding that any agency or person willing to pay a small fee can pull someone’s credit report with personal info such as, name, dob, address etc. and obtain a copy of it (through the 3 amigos: Equifax, Experian, Transunion).
I think it would be safe to assume then that our friends at the IRS have a monthly subscription to the same services and can pull a credit report (and much more of course) and see that there is an outstanding debt obligation for a specific person. It is also safe to assume that our ‘astute’ friends will realize that there is a real property involved that they will more than likely try to lien or seize through completely illegal, unlawful and unconstitutional means. After all, in this hypothetical scenario, this agency is not as nice as the real IRS whose mission is to provide American taxpayers with top notch service while applying tax codes with integrity and fairness to all but is a ruthless KGB like agency that…well, you can imagine the rest.
Anyways, the point of this hypothetical scenario is that this fictional corrupt agency will still be able to see/find/track down the real property and illegally try to seize it. Of course the prince valiant of this story has refused to kneel down at this agency’s feet and even worse, talked back to it and questioned their authority and jurisdiction, which explains why they would be after him. What was he thinking?!?
