    BOBT12,

Wow, where do you find all this stuff?? I rented Blacks Law Dictionary 2nd Edition and have been reading that, but WOW, you have a ton of info – – I would like to know how you know where to look for this stuff so that I can look all this stuff up too!

I thank you for researching this stuff and sharing it – please do not think that you are obligated to do this research.

I think I might visit the Jurisdictionary or suijuirsclub forums for some information, but I don't even know the court rules for my specific traffic court. (I know MOST traffic courts operate under 'informal' rules…I would just at least like the court clerk to provide them to me so I know what they may expect of me.)

[Here's an update on the situation]

I went to the Shawnee County Court today and talked with the 'Traffic' court clerk AND the 'Assistant District prosecutor'. I asked the clerk:

    1. Q. Is the case filed yet? A. No.

    2. Q. Is there a verified criminal or civil complaint against me? A. No, but they will use the ticket as the complaint.

    3. Q. May I have a copy of the judges oath? A. I don't know, I will have to ask him. Come back in about 10 days or when the case is filed on the docket. No one has ever asked me that before.

    4. Q. May I have a copy of the court rules? A. I don't know of any.

    5. Q. May I request my own licensed court reporter? A. I don't know, I will have to ask. Come back in about 10 days when the case is filed.

    6. Q. What happens on the day that I have to come in, according to the ticket? A. The judge will ask how you plead.

    7. Q. I do not plan on pleading anything. Is the traffic court a court of record? A. The traffic court will have it's own court reporter who will make a transcript of the proceedings.

    8. Q. Can I bring in a digital tape recorder to record audio for my own records? A. I don't know. I will ask. Come back when the case is filed and I will have an answer. You can also file any documents at that time.

    9. Q. Do you know what 'File on Demand' is? A. I am not sure what you are asking, I have never heard of that.

    10. Q. Are they going to proceed with prosecution without a verified complaint against me? A. I don't know. You can go down the hall to the prosecutor's office and ask them.

So, off I go to see the wizard (The prosecutor).

I taked to the secretary in the office – who then called a lady to come down to the office.

    1. Q. Are they or you going to proceed with prosecution against me without a verified criminal or civil complaint? A. Yes, we will use the traffic ticket as the complaint.

    2. Q. Is this a court De Jure or Court De Facto? A. NONRESPONSIVE – she just smiled at me and said “I DON'T KNOW”.

    3. Q. Is this the People's court? A. You will have to ask an attorney. (LMAO!!!!!)

    4. Q. I'm not sure exactly how to draft documents to conform to this courts rules. Is there any information available on how to do this? A. You will need to ask an attorney. I will not stand here and tell you how to do anything.

    5. Q. Does this courthouse have a law library? A. No. You can go to the Washburn University's law library (on the other side of town), but there is not one here. [My reply]- Oh. It is my understanding that all courthouses across America must have it's own law library. [Her reply]- Nope. We do not have one here.

    6. Q. Is this a criminal or civil charge? A. It's an infraction.

    7. Q. Since the judge is just an administrator, can he be reprimanded for anything? And by who? A. Yes, if you have a complaint against the judge you can file a complaint with the judicial committee.

I really had no idea how mostly ignorant they were going to turn out to be. I felt as if nobody knew much of anything. I even stated that I'm not asking for legal advice before asking my questions. All I know at this point is that NOTHING has been filed yet regarding the 'seat belt' ticket I was given.

Fact #1: Kansas Legislature / Statutes

This is what is currently advertised.

Fact #2: HOUSE BILL No. 2130 Look on page 12 – 13 of this pdf to find the House Bill 2130 which apparently repealed my fact #1. (How odd)

I was able to check out and bring home with me Black's Law Dictionary Second Edition from the Washburn University Law Library!!! This book is like 4 -5 inches thick; HUGE!!! There is obviously some good info in this book! I really like 'Sui Juris' (Of his own right); which is what I will be in court instead of pro se/pro per. Also, no one could find the Kansas Motor Vehicle Act in a book, or any book containing the federal Motor Vehicle Act. I was trying to find them to photocopy the definitions of the words used in my ticket such as: 'passenger car', 'driver', 'occupant', etc. etc.

I have never had a 'seat belt' infraction – ever. I understand it is of utmost importance for me to challenge this ticket because it is my first one of this type. Had I had one before, it might be extremely difficult to challenge.

BOBT12 – I am currently reading the very last link you put into your post. Right off the bat, I see some juicy tidbits that I find interesting. I know 42 USC 1983 is a fed. law…..I will be doing some research on what my options are, according to content contained in the link you gave me. Thank you kind sir!

God's Peace to all of you!

WOW- You guys in this forum are a lot more 'talkative' than over in SEDM's forum. I really do appreciate all the support from those who have responded to my post – THANK YOU! I have been studying HARD over the last few months, and yes – I have watched a lot of the FREEKEENE.COM videos on youtube. They are informative videos, for sure! I will update you guys as this matter proceeds. I am planning on traveling down to the court and Tuesday (tomorrow) and asking the court clerk if they are going to proceed with prosecution, and if so, I will demand a verified civil or criminal complaint from someone injured by my actions. We shall see what they say.

BOBT12 – thanks for the knowledge about filing as a pauper – I will look in to this. (I have never heard anything about that, ever, so thanks for informing me about that particular option)

All in all, it's only worth $5.00…I am DEFINITELY going to have fun with this case in court!

Does anyone have any NON-legal, educational information about my options, in regards to filing a counter-claim for deprivation of rights. I have read article 42 U.S.C. sec. 1983 – Civil action for deprivation of rights. My understanding is that I do NOT have civil rights, but instead have claimed common-law jurisdiction on my ticket with the notation of 'ALL RIGHTS RESERVED UCC1-308' and reserved all of my un(in)alienable rights.

I am still learning things – as are most of you on this forum…learning NEVER stops for me.

My personal opinion is that this is an election ploy.

Anyone that does enough research into writing that bill should know and understand the administrative and private nature of the codes, and should introduce legislation that would make it mandatory for the government to PUBLISH THE TRUTH regarding the nature and jurisdiction and relationship of the State or State to the man and woman, and the difference between man, person, human being, alien, etc.

THAT would be the patriotic thing to do, in keeping with the highest and only true Law, the Law given by the Creator.

    I agree.

If anyone does research into the laws, you will eventually discover that which is created cannot govern the Creator. Even though the codes, statutes, and ordinances do not apply to me as a private human-being – some may presume otherwise. To me – this bill doesn't affect me. It is my belief that I have had the right to free travel since I was born. I just never knew about it until a couple months ago! This bill MIGHT awaken a few people outside our forum to the truths of government scams perpetuated on a daily basis. 🙂

THIS is AWESOME! Does anyone know if other states are thinking about doing this? Does anyone KNOW why Rep. Franklin did this (did someone write to this guy/gal)?

    UPDATE #1:

I had an interview with my friend on Saturday Sept. 4th. Before he started the interview he told me that he ran into a little bit of a “legal snag”. I asked him to explain. He told me he tried to do the “rehire process” before the interview but the computer system would not let him progress without first inputting an SSN to conduct a “background check for criminal activity”. He told me that he had called his “area manager” based in Kansas City and left a message stating that the person he wants to hire does not technically have an SSN and needed to know what the alternative was to rehire someone without an SSN who can't get one.

After he told me what he had done I told him he did the right thing. He then proceeded with the interview. He did not ask any personal questions during the interview. He said although he was waiting for a callback, the interview went well and he wants me to work for him.

Today is Sunday Sept. 5th – – – no return call yet from the “area manager”.

    ________________________________________________________________________________

I have looked up information about the corporate office located in Kentucky including information about the HR Department Directors. The store I want to work at is located in Topeka, Kansas and is corporate owned and operated.

My friend is doing the right thing by not compelling me to disclose an SSN, however the people in the HR department ARE compelling me to disclose my SSN in order for them to hire me. I talked to an HR rep last Friday who asked if I had a religious objection to the SSN. I said, “Yes, I do, and I am also NOT eligible to apply for one.” She then stated that it was required because they are a Federally Contracted Employer who participates in the E-Verify Program which shows verification of eligibility to work in the United States. I said that I had worked for them in the past. She brought up my information on her computer and told me the dates I had worked and that I had an SSN on file and that the manager of the store could use that for E-Verify. I then asked her if I could send her documentation to update my information. She asked, “Like what, your address?” I replied, “Well, yes, as well as other information.” She said, “You can update your information.” I thanked her for her time and hung up.

I did not record the call, I don't have that technology at my disposal right now.

My next step is to follow up with my friend and see if he got a call back.

If he has not had a call back by Sept. 7th (after Labor Day), my next plan of action will be to send one of the Directors of Papa John's International Inc. a package of documents from both SEDM and Family Guardian and IRS amended forms including:

I-9 Employment Eligibility Verification with an attached Affidavit of Citizenship and Domicile and Tax Status

Government Issued Identity Affidavit signed by a Notary (picture and Birth Certificate)

    IRS Amended W-8BEN

Why I Am Not Eligible for SSN pamphlet

    Withholding Attachment Form

If anyone has educational information about how they dealt with a large corporation regarding “work” please share your experience! Thanks!
