    Divorcing Couples Using Smartphones as Legal Weapons

    Information gleaned from smartphones and text messages is more frequently showing up in divorce cases.

    Smartphones are a wonderful invention that have enriched our lives and made everyday tasks more manageable. However, a knock-on effect of our reliance on these smartphones is that they pretty much know everything about us. So, really, it shouldn't surprise that divorce lawyers are apparently seeing more and more cases where the evidence used was taken from a smartphone.

    All Things Digital's Ina Fried cites the American Academy of Matrimonial Lawyers in reporting the news. According to the AAML, the majority of the organization's members say they've seen a 'sharp rise' in the number of cases citing evidence taken from both smartphones and text messages. AAML says that text messages are the most common form of evidence being presented (62 percent of the time), followed by email (23 percent) and phone numbers and call histories (13 percent). It's apparently still rare to see people highlighting GPS data or internet searches.

    “As smartphones and text messaging become main sources of communication during the course of each day, there will inevitably be more and more evidence that an estranged spouse can collect,” organization President Ken Altshuler is quoted as saying in a statement. “Text messages can be particularly powerful forms of evidence during a divorce case, because they are written records of someone’s thoughts, actions and intentions.”

    Earlier this year, a study from Divorce-Online indicated that Facebook is now being mentioned in one third of British petitions for divorce citing unreasonable behavior. The study was a follow-up to a survey carried out in December 2009, when the divorce blog discovered that 20 percent, or one fifth, of petitions for unreasonable behavior contained the word 'Facebook.' In December of 2011, Divorce-Online conducted the same study, using the same sample size of 5,000 behavior petitions, and found that this 20 percent had risen to 33 percent

    I'm not sure about the reasoning about taxpayers subsidizing non-profits. First there is the entity that claims exemption, say a Christian church. Under the constitution, they would not pay taxes anyway. Because they get a piece of paper 'exempting' them, doesn't add or subtract anything.

    No taxpayer is supporting the church If someone makes a donation to the church and takes the donation off their income tax. May not be true for churches but it is for other charities.

    Churches technically aren't charities. The law doesn't even define what religion is. It is furthermore a violation of the First Amendment to even define what “religion” is.

    If someone makes a donation and deducts that from their tax return, then they, not the exempt entity, has received the privilege. This would be true for any exempt organization

    Donations to tax exempt entities is the issue, the donators are the privileged group that may get an advantage over other tax payers and benefit at their expense. That's the scam. Unequal treatment under the law. The Supreme Court in Pollock called excise taxation “class legislation” that singles out one class at the expense of others. Meaning that they agree that the issue is equal protection and equal treatment.

    Every government program implemented as a franchise and paid for with an excise produces inequality and therefore violates equal protection and equal treatment. Franchises are DESIGNED to make franchisees inferior and unequal in relation to the government offering the franchise. For that reason, I think ALL programs paid for with excise taxes OUGHT to be treated as PRIVATE, non-governmental programs that cannot be protected with sovereign immunity, even if they are established and run by a government.

    This is the FEDERAL UCC. The version for each state may be different. The federal UCC at UCCC 1-103 does not have the provision you cite. The UCC has recently been updated and the provision you cite may have been repealed or replaced. Look at the revision history of the version you derived it from to see.

    My criminal Petition is due in 40 days to the Supreme Court and has numerous issues though I am having to select the ones most egregious (again, which are many). I have concentrated on those issues the 10th Circuit divided both with itself, other Circuits, and the Supreme Court (which is shocking to discover). I received my order from the District Court where they originally allowed a party in the civil case that took my home, to file 6 months out of time, a Motion for Attorney's Fees. I objected over and over again and each time the District Court would just ignored the issue.

    I appealed through Attorney Barringer out of Illinois and the 10th Circuit reversed agreeing the rule gave 14 days not 180. What is so crazy about that decision is how the lower Court continued to ignore the rules it has made for itself just to rule against me. I realize there is bias against the issues I raise but in both cases the Government brought the cases not me. Anyway, the District Court issued its reversal last week and I am certain that it did not wish to do.

    I am still in need of financial support. I plan on typing my Writ in emails so if you would like to see it when it is sent respond back and I will make sure you get it (probably like the way you received this email). In prison things are simply not cheap (15 cents per copy as one example). For those of you that have supported my efforts, I thank you. For those of you who have prayed for me, thank you. For those of you who sent me cards or letters recently, thank you. You are welcome to mail me if you choose not to email. I still need to raise about $ 1500. My family and I greatly appreciate anything you decide to do.

    I have some commentary about political issues that I am also working on. Remember, if we are to produce a different result we must put something different into it. I ask God to show each of you what is wrong with the system so you can better understand how to navigate through it while helping change it. We should never stop doing good.
