    Note that 42 USC is NOT positive law. I do not know the answer to your question but like franklin said, you should drill down at FG and SEDM and see what you find.

    That said, what are you trying to accomplish? Are you trying to teach them a lesson? If so, what lesson?

    what if you “win” your case but you lose the war? Then what?

    I am not telling you what you should do, and God knows that there are alot of corrupted cops out there, but I think you should step back and evaluate if fighting two cops in court, especially if you do not have the local DA office on your side, is a wise decision.

    I just read your Uncle's Will that you linked to in your lead post. I had not seen that web page before.

    Based on your posts, I concur with Admin that your Uncle led an enriching life and he set a high example for those he left behind.

  • Gentleman, it is far, far worse situation than we originally thought.

    The corrupted US Congress and US Government are going to tie having a national ID card, to all kinds of stuff.

    Let me explain.

    There is a proposed Bill in US Congress, titled H.R. 45 the Blair Holt Licensing and Record of Sale Act introduced in Congress a couple of years ago but it never passed. So it is NOT a proposed Bill right now, but it could come up again.

    Here is a brief synopsis:

    The following summary was written by the Congressional Research Service, a well-respected nonpartisan arm of the Library of Congress. GovTrack did not write and has no control over these summaries.

    1/6/2009–Introduced.

    Blair Holt's Firearm Licensing and Record of Sale Act of 2009 – Amends the Brady Handgun Violence Prevention Act to prohibit a person from possessing a firearm unless that person has been issued a firearm license under this Act or a state system certified under this Act and such license has not been invalidated or revoked. Prescribes license application, issuance, and renewal requirements.

    Prohibits transferring or receiving a qualifying firearm unless the recipient presents a valid firearms license, the license is verified, and the dealer records a tracking authorization number. Prescribes firearms transfer reporting and record keeping requirements. Directs the Attorney General to establish and maintain a federal record of sale system.

    Prohibits: (1) transferring a firearm to any person other than a licensee, unless the transfer is processed through a licensed dealer in accordance with national instant criminal background check system requirements, with exceptions; (2) a licensed manufacturer or dealer from failing to comply with reporting and record keeping requirements of this Act; (3) failing to report the loss or theft of the firearm to the Attorney General within 72 hours; (4) failing to report to the Attorney General an address change within 60 days; or (5) keeping a loaded firearm, or an unloaded firearm and ammunition for the firearm, knowingly or recklessly disregarding the risk that a child is capable of gaining access, if a child uses the firearm and causes death or serious bodily injury.

    Prescribes criminal penalties for violations of firearms provisions covered by this Act.

    Directs the Attorney General to: (1) establish and maintain a firearm injury information clearinghouse; (2) conduct continuing studies and investigations of firearm-related deaths and injuries; and (3) collect and maintain current production and sales figures of each licensed manufacturer.

    Authorizes the Attorney General to certify state firearm licensing or record of sale systems.

    Anyway, if the Bill ever gets revived and passes, at the end of the two-year “grace period” allowed under H.R. 45, any person in possession of a firearm (handguns are defined as “firearms”) who is not licensed by the U.S. Attorney General to possess firearms would become a federal felon.

    Here's the Catch 22: To even apply for the required license under H.R. 45, an applicant would be required to present a “Real ID.”

    Now just because HR is not law NOW, doesn't mean that it will not be proposed again at some point in the future. The proposed Bill reveals where the US Govt wants to take the nation.

    This a REAL problem because I know for a fact that many Union states have already rejected participating in the REAL ID program.

    What is going on here is that they are accelerating the speed with which America is becoming a POLICE STATE.

    The corrupted and lying US Government is trying to convert us into criminals.

    We need a revolution!!!

    Glad you are here and happy that you are seeking the Truth about how to secure your personal liberty and freedom.

    As you may know, freedom is not free. The American Governments at federal, state, and local levels are incredibly corrupted on purpose and by design. This is done to trick folks into a franchise/franchiser relationship vis- a- vis the governments, and that is where the unsuspecting are tricked into surrendering their Constitutional Rights in exchange for civil privileges.

    However, no on here is going to spoon feed you what you need to read, know, and do.

    That said, you need to begin by reading and studying the Path To Freedom treatise available for free on the FG website.

    But you have to do more than just read it, you need to click on the htm links and drill down and also read and study the documents and evidence referenced therein.

    I guess-estimate that at a minimum, you will need to spend at least 200 – 400 hours just to get on a firm enough footing. I have spent years and there is still a ton of stuff I do not know.

    Read and study Chapters 1-6 inclusive of the Great IRS Hoax

    Now, go and start teaching and learning the Truth.

    Thank you for sharing the insights above. . . I heartily concur.

    The corrupted judicial branch – (see SEDM treatise titled “What Happened to Justice” does far, far, far too little to hold government workers/public officers accountable for the crimes that are committed by the corrupted federal, state, and local government workers, at the behest of and under the instruction of said governments.

    And if one presumes that all government workers are citizens, then, according to the U.S. Supreme Court in Stein v. New York, 346 U.S. 156, at 184 (1983), these government workers are legally required to disclose the crimes committed by govt workers against the People, to wit:

    “. . . The duty to disclose knowledge of a crime rests upon all citizens. . .”

    So when a government worker/citizen is informed about a crime, they have a legal duty to disclose it. The problem is that to whom should they disclose the crime to? Their corrupted colleagues?

    I do not use Wikipedia but I did go there about 6 – 7 years ago to see what it was about.

    My instincts told me not to trust it after I read some stuff about so – called “Tax Protesters” which I knew was untrue.

    And that was that.

    I have not been back to Wiki ever since.

    I only wish to add that so far as litigation goes, you will always want to file a Rule 201 Motion ASAP and get as many of the favorable facts into the record as you think you may need.

    Rule 201 Motions are a superb way to do an end around the very costly and time consuming pre-trial evidentiary hearings.

    The Federal Rules of Evidence require that judicially noticed facts contained in a Rule 201 Motion MUST be incorporated into the Jury instructions.

    I doubt that Dick Simkanin's lawyers filed a Rule 201 Motion. Nor did Joe Banister's lawyers either. But it is the single most powerful tool that one can use when involved in litigation. A Ruel 201 Motion should

    One has to ask oneself how come attorneys do not routinely file Rule 201 Motions on behalf of their wards, err, I meant, their clients??

    Would you be interested in investing in a phone that can make payments, and moreover, be interested in receiving targeted ads in exchange for discounts?

    ANSWER: No, I would not be interested at all in an Android phone that could allow me to make payments and get discounts.

    My racist ex-girlfriend owns an Andoid and she LOVES it, so she says. But she is a clueless taxpayer. The fact that she loves her Google Android was all I needed to know to convince me that that model phone and any smart phone, was not for me.

    I had a mtg recently with someone who is extremely wealthy and they told me that the Agreement between the FED and US Dept of Treasury expired in JAN 2011 and has not been renewed.

    It is very doubtful that one will find anything on the Web on this topic. But some folks are looking very earnestly as I type this. If we find anything I will let you know.

    The person I met also said that the Amero is not going to be the next currency, but they were evasive when I pressed further.

    The main problem, as many in the FG Forums already know, is that China is still holding about $700+/- Billion in US T- Bills and T- Notes and it is taking a long time for China to dump the US paper. China, India, and Japan have been the key drivers behind the increase in raw material and metal prices, especially gold and silver. Silver is almost $38 per oz.

    The summer months, especially July and Aug 2011 is supposed to be a time period when some interesting announcements will be coming down the pike on the Fed vs. US Dept Treasury rift – so says my acquaintance.

    I see both sides of what you all are saying. And I appreciate your insights on this.

    Many years ago I used to go to Supreme Law almost every day. I learned alot from that web site and am grateful.

    But I was turned off by the tone of some of his writings. And I learned from his flaws too. I try and learn from anyone I can. Even if it means learning how NOT to conduct oneself or what NOT to write.

    I am one of the few who can say that I actually read darn near everything Mitch posted on that website. But I outgrew him and his materials.

    Still, I think his 23 Questions about IRS are superb though. And his Federal Zone, 11 edition book is good too, but not on par with Great IRS Hoax (http://famguardian.org/Publications/GreatIRSHoax/GreatIRSHoax.htm).

    I cut my teeth on the issue of Jurisdiction by studying Mitch's stuff, especially his chapter on jurisdiction, and then combining that with Ed Rivera' (http://edrivera.com) materials. And then going off and creatively researching stuff myself.

    But I have to say, Mitch in some cases, planted the seed for me to seek more Truth. However, I am not quite sure that he is the most mentally stable person. Sometimes he appears erratic, at best, it is hard to explain.
