A San Francisco man has reached an agreement with Marin County over his $10 million claim that he was falsely arrested during a judges forum in San Rafael last year.

Under the agreement, announced yesterday by County Counsel Patrick Faulkner, former Mill Valley resident Kenneth J. Schmier will get 30 minutes to address the county Board of Supervisors at a regularly scheduled Tuesday Board Meeting. The is tentatively set for Dec. 14 at 11 a.m.

In return, Schmier has agreed to abandon his claim against Marin of false arrest, false imprisonment and defamation by county and state employees.

Marin sheriff’s deputies arrested Schmier on Oct. 28, 1998, at a "Meet Your Judges" night meeting at Marin Veterans’ Auditorium when he continued to speak after moderator Judge Stephen Graham asked him to sit down.

Schmier was questioning judges about current judicial rules related to nonpublication/noncitation of appellate court decisions.
